Additionally, food education and training programs are now required to include food allergy information, and a food manager certificate examination must include this information. Growing the Regulatory State through an Excessive "Food Allergen Awareness" Poster Mandate on all Restaurants and Food Establishments.

This bill allows individuals who are not alcohol permit or license holders to sell wine to restaurants, provided the wine is at least 20 years old and still sealed. The restaurant may then sell the wine for on-premises consumption. Support is the position of the Texas GOP Platform under Markets and Regulation Section 41: "Reduce Business Regulations". "We believe that the following businesses shall be minimally regulated at all levels: Eliminate the three-tier alcohol system (production, distribution, and retail)."

Expanding Individual Liberties by Allowing Individuals to Sell Sealed 20+ Year Old Wine to Restaurants.

This bill expands the Rural Veterinarian Incentive Program, which provides taxpayer-funded loan repayment to veterinary students and recent graduates who agree to work in counties with populations below 150,000. Previously, eligibility was limited to counties with populations below 100,000. Oppose is the position of the Texas GOP Platform under Opposition to Market-Distorting Tax and Fiscal Subsidies Section 95: "Bailouts and Subsidies". "We encourage government to divest its ownership of all businesses that should be run in the private sector. We oppose all bailouts of and subsidies to domestic and foreign government entities, states, and for all businesses, public and private."

Growing Government Central Planning and Runaway Spending by Forcing Taxpayers to Pay Off the Student Loan Debt of Veterinarians in Additional Regions of the State.

This bill contains several provisions related to the release of individuals charged with felonies. Most significantly, the bill prohibits the release of a defendant on their own recognizance (no bond required) if they are charged with certain offenses, such as manufacture or delivery of fentanyl, terroristic threats, or unlawful possession of a firearm. Additionally, a magistrate may not release a defendant charged with a felony unless the defendant appears before the magistrate and the magistrate has considered the public safety report, which includes the defendant's criminal history. The bill also allows prosecutors to appeal a bail amount as being insufficient if a defendant is charged with a felony and is already out on bail for another pending felony. Support is the position of the Texas GOP Platform under Courts, Prosecutions, Restitution Section 185: "Bail Reform". "We call upon the Texas Legislature to ensure bail in Texas is based only on a person’s danger to society, risk of flight, and criminal history."

Strengthening Law and Order by Ensuring Bail is Imposed for Most Felony Offenses.

This bill provides $100 million in funding to establish a new state border policing unit made up of commissioned peace officers. Funding is also directed to a number of initiatives designed to boost border security such as detention facility upgrades, temporary border barriers and compensation to certain property owners impacted. Support is the position of the Texas GOP Platform under Border Security and Immigration Section 256: "Border Security Funding". "We expect both the Texas Legislature and the United States Congress to make a priority of allocating funds to effectively secure the border through whatever means necessary, including but not limited to barriers, a border wall, and/or fence everywhere along the border where it is feasible and useful, as well as personnel and technology over land, sea, and air. Texas shall seek repayment from the Federal Government for expenses incurred in securing the border."

Strengthening National Security and Helping to Combat Illegal Immigration and Human Trafficking Through Additional Border Security Funding and Property Owner Compensation.

This bill primarily targets a business model within the optometry industry which has been deployed by Visionworks of America, which is owned by an insurance company called Vision Services Plan (VSP) Insurance Co. The bill prevents VSP from incentivizing its enrollees to utilize the optometry company it owns (Visionworks) through the offering of discounts or other value-added benefits. Other optometry companies have alleged that since VSP owns its own optometry company and can "steer patients" it is provided an unfair competitive advantage in the industry. Oppose is the position of the Texas GOP Platform under Markets and Regulation Section 41: "Reduce Business Regulations". "We believe that .. businesses should be minimally regulated at all levels". 

Expanding Government Power to Shutdown Competition within the Optometry Industry.

This bill creates a statewide framework for natural gas utility companies to offer energy conservation programs. These programs typically involve subsidies for purchasing higher energy efficiency appliances or for retrofitting a home or business to increase energy efficiency. The programs are paid for by raising natural gas utility rates on all customers through "rate recovery" which also provides utility companies a larger guaranteed profit. Additionally, the bill allows utility companies (which heavily lobbied for the bill) to receive additional profit for designing, marketing, administering, and delivering an energy conservation program. Oppose is the position of the Texas GOP Platform under Energy and Environment Section 53: "Utilities". "We support free-market solutions for providing resilient and reliable utilities."

Hiking Natural Gas Utility Costs for Texans to Enrich Utility Companies and Create New Energy Conservation Programs.

This bill prohibits localities from issuing bonds (debt) to purchase or lease tangible personal property if the property will no longer be useful before the debt matures. According to the bill's sponsor, local debt reached $417 billion in fiscal year 2022. Support is the position of the Texas GOP Platform under School Finance and Property Taxation Section 92: "Bonds Create Bondage". "We urge the Texas Legislature to amend the Texas Election Code to require bond issues be approved by a 2/3 majority of those voting and only if 20% of all registered voters in the district cast ballots. Taxpayer standing must be established to allow taxpayers to hold government entities accountable."

Protecting Taxpayers by Prohibiting Localities from Issuing Bonds (Debt) to Purchase Personal Property that has a Lifecycle Expected to Expire Before the Bond Matures.

This bill imposes a series of new regulations which are largely designed to prevent property insurance companies from steering their policy holders to select a contractor favored by the insurer to make the repairs. For example, an insurer is now no longer permitted to waive or reduce a deductible if policy holders utilize a contractor favored by the insurer. Oppose is the position of the Texas GOP Platform under Markets and Regulation Section 41: "Reduce Business Regulations". "We believe that .. businesses should be minimally regulated at all levels". 

Hiking Consumer Property Insurance Costs by Imposing New Protectionist Regulations on Insurance Deductibles.

This bill, the Creating a Respectful and Open World for Natural Hair (CROWN) Act, makes a person's hair texture or hairstyle a protected characteristic if is commonly associated with a particular race. CROWN applies to public schools and institutions of higher education, employment, and housing. Oppose is the position of the Texas GOP Platform under Courts, Prosecution, Restitution Section 184: "Frivolous Lawsuits". "We support further reform to discourage frivolous lawsuits. We oppose the abusive use of class action lawsuits and any law that allows government agencies to collect lawyer fees from the plaintiff when they win but not have to pay the plaintiff fees when they lose."

Increasing Frivolous Litigation and Legal Liabilities by Making "Hair Texture and Style" a Protected Characteristic in Employment and Housing.

This bill provides additional state subsidies ($25 million) to builders and purchasers of housing under the federal Low-Income Housing Tax Credit (LIHTC) program. The LIHTC program subsidizes the acquisition, new construction, and rehabilitation of affordable rental housing for low- and moderate-income tenants. Oppose is the position of the Texas GOP Platform under Opposition to Market-Distorting Tax and Fiscal Subsidies Section 95: "Bailouts and Subsidies". "We encourage government to divest its ownership of all businesses that should be run in the private sector. Expanding Cronyism and Diluting the Tax Base Through Additional Subsidies under the Low-Income Housing Tax Credit (LIHTC) Program.

This bill implements a system in which political candidates, election judges and proponents/opponents of a measure can inquire about identified election irregularities and ultimately raise the issue with the Secretary of State. Support is the position of the Texas GOP Platform under Elections Section 242: "Fair Elections Procedures". "We support the right of eligible voters to cast a ballot in each election once, but we oppose illegal voting, illegal assistance, or ineligible persons. We support: Creating processes that will allow rapid adjudication of election law violation disputes as they occur and before violations can be successfully perpetrated."

Strengthening Election Integrity through a System for Candidates and Election Judges to Inquire About Election Irregularities and Seek Review by the Secretary of State.

This bill eliminates the expiration of a provision in state law which requires school districts to obtain parental consent in order for a student to receive instruction on human sexuality. This requirement had been set to expire August 1, 2024. Support is the position of the Texas GOP Platform under Parents' Rights Section 105: "Sexual Education". "We demand the State Legislature pass a law prohibiting the teaching of sex education, sexual health, or sexual choice or identity in any public school in any grade whatsoever, or disseminating or permitting the dissemination by any party of any material regarding the same. Until this prohibition goes into effect, sexual education shall only utilize sexual risk avoidance programs and promote abstinence outside of marriage. Before a student may be provided with human sexuality or family planning instruction, the district must obtain the written consent of the student’s parent or guardian [Opt-In status]."

Strengthening Parental Rights in Education by Prohibiting Discussion of Sensitive Issues Surrounding Human Sexuality without Parental Consent.

This bill requires an aspiring dietician to now obtain a master's degree, register with a national commission, complete an internship or other accepted training program, and undergo examination to work in the profession. Oppose is the position of the Texas GOP Platform under Markets and Regulation Section 39: "Licensing". "We call upon the Texas Legislature to review all Texas Department of Licenses and Regulations (TDLR), business/professional licensing programs, and associated licensing for the purpose of abolishing or removing as many as reasonably possible and repealing those laws, rules, and regulations."

Increasing Employment Barriers and Enriching Certain Educational Institutions by Forcing Dieticians to Obtain Masters Degrees.

This bill prohibits a municipal library from receiving state or public funds for a period of a year if it hosts a "drag queen" event where a person dressed as the opposite gender reads a book or story to a minor. Support is the position of the Texas GOP Platform under Family and Gender Issues Section 209: "Protect Minors Until Age of Consent". "A law shall be enacted to protect the rights of the individual until the age of consent is reached. b. Protect against predatory sexual behaviors, including but not limited to “Drag Queen Story Hour.” 

Protecting Minors from Sexual Content by Defunding Public Libraries which Host Drag Queen Events.

This bill allows localities to implement a property tax credit equal to at least 50% of the value of property used for childcare services. Only facilities in which at least 20% of the children receive subsidized childcare services are eligible. Additionally, if the property owner leases the property to a childcare facility, the rent charged must be reduced to reflect the tax credit received. Oppose is the position of the Texas GOP Platform under Opposition to Market-Distorting Tax and Fiscal Subsidies Section 94: "Property Tax Abatements". "We support repealing Tax Code Chapter 312 county and municipal property tax abatements, and we oppose reintroducing school property tax abatements, formerly known as Chapter 313."

Hiking Property Taxes through a New Tax Exemption Scheme which Socializes Childcare Facility Costs.

This bill extends the Texas Economic Development and Tourism Office for an additional 12 years, until September 2035. This office is focused on "marketing and promoting the state of Texas." Oppose is the position of the Texas GOP Platform under Spending Restraint Section 75: "Government Spending and Taxation". "We believe in the principles of constitutionally limited government based on federalist principles. To this end, we encourage our elected officials at all levels of government to work to reverse the current trend of expanding government and the growing tax and debt burdens placed on “We the People.” Government spending is out of control at the federal, state, and local levels, and action is needed to reduce spending, and therefore taxation, at all levels."

Fueling Tens of Millions in Wasteful Spending by Extending the Unnecessary Texas Economic Development and Tourism Office for Another 12 Years.

This bill, the Fiscal Years 2024-2025 Operating Budget, represents a 21.3% increase over the prior budget, and the largest in state history. Some of the major new and increased spending initiatives within the bill include $1 billion for land acquisition for parks (3603.7% increase over the $27 million appropriated in the previous budget), an additional $100 million for the Texas Water Development Board Economically Distressed Areas Program, and $45.9 billion for business and economic development (25.8% increase). Oppose is the position of the Texas GOP Platform under Spending Restraint Section 76: "State Fiscal Restraint". " We urge the Legislature to amend the Texas Constitution and State statute with a stricter spending limitation based on US Census population growth plus inflation, as measured by the Consumer Price Index, and apply the new limit to Texas’s total government budget. We call on the Texas State Legislature to freeze State spending until wasteful programs have been eliminated, a sustainable size of government has been restored, and substantive property tax relief has been provided to Texas citizens. Any budget surplus shall be applied to property tax relief."

Fueling Out-of-Control Spending Through a $321.3 Billion Budget (21.3% Increase) with Countless Provisions that Further Grow the Size and Scope of Government.

This bill increases the personal needs allowance provided to Medicaid welfare recipients at long-term care facilities (nursing homes). Under the bill the monthly allowance is increased by 25 percent to $75 from $60, which is more than double the federal $30 monthly minimum. Oppose is the position of the Texas GOP Platform under Government-funded Health Programs Section 146: "Welfare Reform". "We support the abolition of all federal welfare programs, as they are not an appropriate role of the federal government. Until such time, welfare reform should encourage partnerships with faith-based institutions, community, and business organizations to assist individuals in need. We oppose any further expansion of Medicaid."

Further Growing Medicaid Welfare Spending by Hiking the Monthly Personal Needs Allowance at Long-Term Care Facilities.

This bill prohibits local governments from enacting any ordinances which bans or restricts the sale or use of an engine based on the type of fuel used. Additionally, the bill prevents localities from banning any energy source infrastructure (such as gas stations). Support is the position of the Texas GOP Platform under Transportation Section 63: "Freedom to Travel". "We oppose the Biden Infrastructure and Green Energy Plan that threatens our freedom to travel, imposes a federal mileage tax, as well as Diversity, Equity, and Inclusion (DEI) or other social justice policies on Texas taxpayers and drivers. We oppose anti-car measures that punish those who choose to travel alone in their own personal vehicle, and oppose any measure to impose “road diet” mandates designed to shrink auto capacity and/or intentionally clog vehicle lanes to force deference to pedestrian, bike, and mass transit options (whose users do not pay gas tax)."

Protecting Consumer Choice by Preventing Localities from Imposing any Ordinance which Restricts or Bans Gas-Powered Engines or a Source of Energy.

This bill establishes a 10-year mandatory minimum sentence if a firearm was used to commit a very serious crime. Examples include felony offenses committed in the first, second or third degree such as murder, human trafficking, burglary, sexual assault, or kidnapping. Support is the position of the Texas GOP Platform under Courts, Prosecution, Restitution Section 188: "Rule of Law Enforcement". "We support rule of law and enforcement of laws, which maintain an ordered republic."

Strengthening Law and Order by Imposing 10-Year Mandatory Minimum Sentences for Serious Firearm Felonies.

This bill provides that businesses with revenue up to $2.47 million are not required to pay any franchise tax (previously $1 million). Additionally, those businesses are no longer required to file a tax information report. Support is the position of the Texas GOP Platform under Spending Restraint Section 82: "Repeal Taxes". "We support abolishing the following: Business franchise taxes."

Expanding Economic Growth by Increasing the Franchisee Tax Exemption from $1 Million to $2.47 Million.

This bill, the Alan Vera Memorial Act, contains several provisions related to election integrity. The bill expands the required cooperation of the Secretary of State with other states to identify ineligible voters. Additionally, the bill requires the Secretary to contract with a private sector data system to identify voters whose addresses have changed, are registered to vote in more than one state, are deceased, or who are not eligible to vote due to a felony conviction. Finally, the Secretary is required to use the National Change of Address database to identify voters whose addresses have changed to prevent multiple registrations. Support is the position of the Texas GOP Platform under Elections Section 242: "Fair Elections Procedures". "We support the right of eligible voters to cast a ballot in each election once, but we oppose illegal voting, illegal assistance, or ineligible persons. We support: Allowing, by Open Records Request, a bit-by-bit forensic imaging of all electronic devices, including servers, at Central Counting immediately before and after each election."

Strengthening Election Integrity through an Additional Voter Crosscheck.

This bill allows cities which have a municipal street sales tax to call an election to authorize the tax for a period of 8 to 10 years if a majority of voters approved the tax in the last 2 elections. In most cities, the duration of the tax is limited to 4 years. Additionally, the bill expands the permitted uses of the tax to include not only maintenance and repair of streets and sidewalks, but now also water, wastewater, or stormwater systems located under a city street. Oppose is the position of the Texas GOP Platform under Spending Restraint Section 75: "Government Spending and Taxation". We believe in the principles of constitutionally limited government based on federalist principles. Reducing Government and Fiscal Accountability by Allowing Municipal Tax Levies to Continue for up to 10 Years (Previously 4 Years) without Voter Approval.

This bill requires school districts to allow parents the option to be notified whenever their child checks out materials from a school library, including the title and genre. Additionally, the bill prohibits school libraries from acquiring materials containing harmful, indecent, or profane content. Support is the position of the Texas GOP Platform under Parents' Rights Section 109: "Education Transparency". "We support requiring Texas public schools to be fully transparent with parents regarding everything to which their child is or will be exposed, without exception. We require that copyright and competitive advantage are not acceptable reasons to withhold information from a parent or taxpayer."

Strengthening Parental Rights in Education by Ensuring only Age-Appropriate Materials are Displayed in Public School Libraries.

This bill expands eligibility under the "Major Events Reimbursement Fund" to include a larger range of events ranging from Formula 1 to the country music awards, and equestrian competitions. Oppose is the position of the Texas GOP Platform under Opposition to Market-Distorting Tax and Fiscal Subsidies Section 97: "Special Funds". "We urge the Texas Legislature to abolish the Special Events Trust Fund program, the Texas Enterprise Fund, and the Moving Image Industry Incentive Program."

Worsening Cronyism and Government Central Planning by Forcing Taxpayers to Subsidize an Even Greater Range of Events (Formula 1 and Equestrian) under the "Major Events Reimbursement Fund".

This bill allows school districts and charter schools to employ a chaplain for purposes of providing "support, services, and programs" to students. The bill also allows volunteer chaplains and provides that chaplains are not required to be certified by the State Board for Educator Certification. Support is the position of the Texas GOP Platform under Parents' Rights Section 108: "Religious Freedom and Public Schools". We urge school administrators and officials not to infringe on Texas school students’ and staffs’ rights to pray and engage in religious speech, individually or in groups, on school property without government interference. We urge the Legislature to end censorship of discussion of religion in our founding documents and encourage discussing those documents, including the Bible as their basis. Students have the right to exhibit religious items on school property. "

Protecting the Ability of School Districts and Charter Schools to Employ Chaplains.

This bill establishes a specialized "Business Court" to hear cases involving certain business transaction and governance matters, with the judges appointed by the Governor. Judges are required to have at least 10 years of experience practicing complex civil business litigation or business transaction law, or as a judge of a court with civil jurisdiction. Support is the position of the Texas GOP Platform under Courts, Prosecution, Restitution Section 184: "Frivolous Lawsuits". "We support further reform to discourage frivolous lawsuits. We oppose the abusive use of class action lawsuits and any law that allows government agencies to collect lawyer fees from the plaintiff when they win but not have to pay the plaintiff fees when they lose."

Improving the State's Business Climate by Creating a Specialized Business Court to Hear Cases and Expedite Legal Proceedings.

This bill prohibits local governments from enacting any ordinances which require a firearm owner to obtain liability insurance for "damages resulting from negligent or willful acts involving the use of the firearm." Support is the position of the Texas GOP Platform under Citizen Rights Section 32: "The Right to Keep and Bear Arms". "State and Federal Legislatures shall: Nullify any gun laws that violate the 2nd Amendment or rights of due process."

Protecting Second Amendment Rights by Preventing Localities from Imposing Liability Insurance Mandates on Firearm Owners.

This bill creates both the "Texas Space Commission" and the Aerospace Research and Space Economy Consortium to promote innovation in the space, aeronautics, and aviation industry. The new entities are expected to require the hiring of at least 10 additional state employees at an estimated cost of $3.4 million over the next two years. Oppose is the position of the Texas GOP Platform under Spending Restraint Section 76: "State Fiscal Restraint". " We urge the Legislature to amend the Texas Constitution and State statute with a stricter spending limitation based on US Census population growth plus inflation, as measured by the Consumer Price Index, and apply the new limit to Texas’s total government budget. Growing Government Bureaucracy and Wasteful Spending through the Creation of the Texas Space Commission and the Aerospace Research and Space Economy Consortium.

This bill requires that for any ballot proposition that would increase or impose a new tax, the ballot must include the language "THIS IS A TAX INCREASE" in all capital letters. Support is the position of the Texas GOP Platform under Spending Restraint Section 81: "Public Posting". We support all government entities compiling and publicly posting their current debt, future obligations, financial statements, check registers, and all government contracts on their official websites.  

Protecting Taxpayers by Requiring Clear Notification of Tax Increases on Ballot Propositions.

This bill prevents public colleges and universities within the state from taking certain actions against student organizations due to their membership policies surrounding sincerely held beliefs. Support is the position of the Texas GOP Platform under Higher Education Section 130: "Campus Speech". "We urge the Texas Legislature to recognize the rights of those on college campuses to practice their faith and their right to free speech. We support withdrawal of public funding from any college or university within this state that actively or passively discriminates or permits discrimination against the free speech of either students or guest speakers. Student groups shall have the unfettered right to elect their leaders, choose their members, and set their organization’s mission, purpose, and standard of conduct."

Protecting Free Speech and Assembly on Public College Campuses by Ensuring Student Organizations Can Set Membership Policies Based on their Sincerely Held Beliefs.

This bill eliminates the state's mandatory vehicle safety inspection effective January 1, 2025. As a result, car owners will no longer be forced to annually take their vehicle in for an inspection, however a $7.50 annual fee (the current inspection fee) will still be assessed on vehicle owners. Texas was one of only 13 states which required annual vehicle inspections. Support is the position of the Texas GOP Platform under Transportation Section 64: "Vehicle Taxes". "Only commercial vehicles should be required to obtain a state safety inspection."

Providing Significant Regulatory Relief to Car Owners by Eliminating the State's Mandatory Annual Vehicle Safety Inspection.

This bill prohibits local governments from imposing any additional regulations which restrict or delay eviction proceedings. Support is the position of the Texas GOP Platform under Markets and Regulation Section 38: "Municipal Preemption". " We encourage the Legislature to preempt local government efforts to interfere with the State’s sovereignty over business, employees, and property rights. This includes but is not limited to burdensome regulations on short-term rentals, bags, sick leave, trees, and employee criminal screening."
